SWEEPSTAKESFINDERS.COM DOES NOT OWN, OPERATE, ADMINISTER, OR SPONSOR ANY SWEEPSTAKES, CONTEST, GIVEAWAY, OR PROMOTIONAL OFFER LISTED ON THIS SITE UNLESS EXPLICITLY STATED OTHERWISE.

The following important limitations apply to all sweepstakes listings on this Site:

10. Dispute Resolution and Arbitration

A. Informal Resolution

Before initiating arbitration, you agree to attempt to resolve any dispute informally by sending written notice to support@sweepstakesfinders.com describing the dispute and your proposed resolution. We will have sixty (60) days to attempt resolution. If unresolved, either party may initiate arbitration.

B. Binding Arbitration

ANY AND ALL DISPUTES THAT CANNOT BE RESOLVED INFORMALLY MUST BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JAMS IN ACCORDANCE WITH JAMS’ THEN-CURRENT STREAMLINED ARBITRATION RULES. BY AGREEING TO ARBITRATE, EACH PARTY WAIVES THE RIGHT TO GO TO COURT OR HAVE ANY DISPUTE HEARD BY A JUDGE OR JURY. We will pay JAMS fees and the arbitrator’s fees. You are responsible for your own attorney’s fees. All arbitration shall be governed by the Federal Arbitration Act (9 U.S. Code §§ 1–16).

C. Time Limit

ANY CLAIM MUST BE INITIATED WITHIN ONE (1) YEAR AFTER THE DISPUTE ARISES OR IT WILL BE FOREVER BARRED.

D. No Class Actions

YOU WAIVE THE RIGHT TO BRING ANY DISPUTE ON A CLASS OR COLLECTIVE BASIS IN ANY FORUM. THE ARBITRATOR MAY NOT FORM A CLASS OR PROCEED ON A COLLECTIVE BASIS.

E. Governing Courts

If arbitration is found unenforceable, you irrevocably consent to the exclusive jurisdiction of the state courts of Pennsylvania for all disputes.

F. Jury Trial Waiver

YOU EXPRESSLY WAIVE THE RIGHT TO A JURY TRIAL FOR ANY DISPUTE BROUGHT IN STATE OR FEDERAL COURT.

G. Small Claims Exception

Either party may bring a qualifying dispute in a small claims court of competent jurisdiction.

11. Disclaimer of Warranties

THE SITE AND ALL CONTENT, LISTINGS, AND INFORMATION ON IT ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT.

We make no warranty that: (i) any sweepstakes listing is accurate, current, or complete; (ii) any sweepstakes is legitimate or compliant with applicable law; (iii) you will win any sweepstakes; (iv) any third-party sponsor will fulfill any prize; (v) the Site will be available, uninterrupted, or error-free; or (vi) the Site is free of viruses or harmful components.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SWEEPSTAKESFINDERS.COM OR ITS EMPLOYEES, AGENTS, LICENSORS, OR ASSIGNS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM: (A) YOUR USE OF OR INABILITY TO USE THE SITE; (B) ANY SWEEPSTAKES LISTING ON THE SITE, INCLUDING ANY INACCURACY, EXPIRATION, OR FRAUDULENT NATURE THEREOF; (C) YOUR ENTRY INTO OR PARTICIPATION IN ANY SWEEPSTAKES; (D) ANY FAILURE BY A THIRD-PARTY SPONSOR TO AWARD OR FULFILL A PRIZE; (E) ANY DATA COLLECTED FROM YOU BY A THIRD-PARTY SPONSOR; (F) ANY ERRORS, OMISSIONS, OR INTERRUPTIONS IN THE SITE; OR (G) ANY UNAUTHORIZED ACCESS TO YOUR INFORMATION.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED DOLLARS ($100.00).

13. Updates to Terms

We may modify these Terms at any time by posting the updated Terms on the Site. Your continued use of the Site after any update constitutes your acceptance of the new Terms. You should review the posted Terms each time you use the Site.

14. General Provisions

A. Applicable Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, excluding its choice-of-law rules. We are not your agent, partner, joint venturer, attorney, or financial advisor.

B. Indemnity

You agree to defend, indemnify, and hold us and our employees, agents, licensors, and assigns harmless from any claims, damages, losses, costs, and expenses (including attorneys’ fees) arising from: (i) your use of the Site; (ii) your breach of these Terms; (iii) your violation of any applicable law; (iv) your submission of User Content; or (v) any misrepresentation made by you.

C. Severability

If any provision of these Terms is found invalid or unenforceable, it will be deemed severable and the remaining provisions will remain in full force and effect.

D. No Waiver

Failure to enforce any right under these Terms does not constitute a waiver of that right.

E. Assignment

We may assign our rights and obligations under these Terms to any party without notice. You may not assign your rights without our prior written consent.
